Thank you for choosing Dark Dojo Studios, LLC ("Dark Dojo Studios," "we," "us," or "our"). By accessing or using any of our video games, websites, digital products, or services, including the DDS Extraction Shooter Kit (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Services. If you do not agree to these Terms, do not use the Services.

1. Acceptance of Terms

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. These Terms apply to all users, including visitors, players, customers, and Kit license holders.

2. Changes to the Terms

We may update, modify, or replace these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Services after changes are posted constitutes your acceptance of those changes.

3. User Accounts

Some features of the Services may require an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are solely responsible for keeping your account credentials confidential and for all activity under your account.

4. Our Games: License to Play

For video games and game content we sell or distribute to you as a player, Dark Dojo Studios grants you a limited, non-exclusive, non-transferable license to use that game and its content for personal, non-commercial play, subject to these Terms. This license does not give you ownership of the game or its content, and it is separate from the Kit license described in Section 5.

5. The DDS Extraction Shooter Kit

The DDS Extraction Shooter Kit (the "Kit") is a development product: systems, source code, Blueprints, assets, and documentation for building your own games in Unreal Engine. Your use of the Kit is governed by the DDS Extraction Shooter Kit License Agreement (the "Kit License"), which is provided with the Kit and controls over these Terms if they conflict with respect to the Kit. In summary:

You own your game. The original game content you create with the Kit belongs to you. You may build and ship commercial games made with the Kit on any platform, with no limit on titles released or copies sold.
No royalties. You owe Dark Dojo Studios no royalties, revenue share, or licensing fees on games you build and sell with the Kit. Your only obligations are holding a valid license and providing attribution.
Valid license required. Developing with the Kit requires an active Dark Dojo Studios Patreon membership or a one-time Kit license purchased from darkdojostudios.com. If your membership lapses without a one-time license, your right to continue developing with the Kit ends, though games you have already released may remain published.
Attribution. Every released game built with the Kit must include a visible credit identifying Dark Dojo Studios, LLC as the provider of the underlying systems, for example "Core systems powered by Dark Dojo Studios, LLC."
The Kit itself stays ours. Dark Dojo Studios retains full ownership of the Kit and its intellectual property. You may not resell, redistribute, sublicense, or share the Kit or its source files, upload it to public repositories or marketplaces, or use it to create a competing kit, framework, template, tool, or service.

6. Prohibited Conduct

You agree that you will not:

Use the Services for any unlawful or fraudulent purpose.
Engage in harassment, abuse, or disruptive behavior toward other users or our employees.
Reverse-engineer, decompile, or disassemble our games or attempt to discover their source code. This does not restrict Kit license holders from studying, modifying, and extending the Kit's source as permitted by the Kit License.
Use unauthorized third-party software, cheat programs, or hacks in connection with our games.
Use the Services in any manner that could damage, disable, or impair their operation or interfere with other users' enjoyment.

7. Purchases, Virtual Items, and Refunds

Some of our games may offer virtual items or in-game content for purchase with real money. All purchases of virtual items are final and non-refundable, as outlined in our Return and Refund Policy. You agree not to sell, trade, or transfer virtual items or in-game currency outside the game unless we expressly permit it. Kit purchases and Patreon memberships are likewise non-refundable, as stated in the Kit License.

8. Ownership of Content

All content of our games and the Services, including game assets, graphics, characters, and code, is the intellectual property of Dark Dojo Studios, LLC. Except for the rights expressly granted to you in these Terms or the Kit License (including your ownership of original game content you create with the Kit), you acquire no ownership rights and may not copy, distribute, or otherwise use our content outside the scope of your license.

9. Privacy and Data Collection

By using the Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy. Please review it to understand how we handle your data.

10. Termination and Suspension

We may suspend or terminate your access to the Services at any time, without notice, if we believe you have violated these Terms, or for any other reason at our sole discretion. Termination of a Kit license is governed by the Kit License; in general, breach terminates the license automatically and requires you to stop using the Kit and delete your copies, while games you have already published may remain available. You may terminate your account at any time by contacting customer support.

11. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the Services, including the Kit, are provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee uninterrupted, secure, or error-free operation. You are responsible for testing games you build with the Kit and for meeting all platform and legal requirements that apply to them.

In no event will Dark Dojo Studios, LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Dark Dojo Studios, LLC, its officers, employees, agents, and affiliates from any claim, liability, loss, damage, or expense (including reasonable attorney fees) arising from your use of the Services, the games you create and publish with the Kit, your violation of these Terms or the Kit License, or your infringement of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms or your use of the Services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and, for Kit license holders, the Kit License Agreement, constitute the entire agreement between you and Dark Dojo Studios, LLC regarding the Services.
Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
